Metzler called the meeting to order at 7:37 p.m.

F.    Applications Received After Post-Agenda Filing

1.  File #W2005-18 – Application to conduct a timber harvest on property south of Jared Sparks
    Road just east of its intersection with Cosgrove Road (Map 32, Lot 5-B).  Owners:  Eugene
    & Marie Pal; Applicant:  Hull Forest Products, Attention:  Eric Johnson.  (Received 6/13/05;
    Decision by 7/25/05.)

No one was present to speak; the application was tabled.

G.    Old Business

1.  File #W2005-06 – Application for 14-Lot Subdivision on property at 22 Kuchko Road
    (Map 42, Lot 8-1).  Owners:  R. F. Crossen & Joan Aitchison; Applicant:  R. F.
     Crossen Contractors, LLC.  (Received 3/14/05; 35-day extension requested and approved;
     decision by 6/27/05.)

Mark Peterson, from Gardner & Peterson Associates, and Atty. Tom Marian were present to speak.  Mr. Peterson said he had worked on Karl Acimovic’s concerns and returned the plans to the town and Karl Acimovic.  He said he had met with Mr. Acimovic, Sue Yorgensen, and Lynn from Public Works.  Metzler asked if there was correspondence in the file concerning that meeting, and Jones replied no.  Mr. Peterson said there are steep grades on the driveways for Lots 7 and 8.  A double basin is needed.  He said they also added a yard drain along the edge of the right of way on Lot 8, as well as a sediment basin.  There is an existing 15” pipe under Kuchko Road.  He said they had designed the detention basin to not allow any increase in peak flows.  He said they have addressed all IWC concerns.  

Metzler asked if there were any upgrades to Kuchko Road, and Mr. Peterson replied no, not at this time.  Metzler said that without improvements, there would be significant erosion problems on Roaring Brook Road.  He said it is within the discretion of the Commission to consider indirect impacts.

Atty. Marian said they had a “chicken and egg” situation in regard to P&Z.  Mr. Peterson said there were concerns about the dirt road (Kuchko).  They have a series of catch basins to correct the flow.  Metzler suggested the applicant’s engineer take care of the problems.

There was discussion about possible improvements to Kuchko Road.

Atty. Marian suggested that P&Z exercise their jurisdiction first.  Metzler said that IWC has three options:  deny, approve, and approve with the condition that the road improvements worked out with P&Z be approved by IWC.  Jones said the applicant should have proposed something for road improvements.  He noted that Karl Acimovic hadn’t approved the plans yet.

MOTION:  To approve File #W2005-06 – Application for 14-Lot Subdivision on property
at  22 Kuchko Road, with the condition that the recommendations made by  P&Z on the road be referred back to IWC for its approval. (Any changes in the plan may require a modification or a new permit.)

2.  #W2005-08 – Application for 15-Lot Subdivision – Lechowicz Estates – Section II,
    on property on Mihaliak Road Ext.  (Map 50, Lot 3).  Owners/Applicant:  Mary C.
    Litwinczyk & Litwinczyk Children, LLC.  (Received 3/28/05, Decision by 5/23/05.)

Ed Pelletier from DATUM Engineering and Surveying, John Ianni, Soil Scientist, and Dave Batista were present.  Mr. Pelletier passed out copies of revised plans.  He said that some details were on the drainage report but not on the plans.  He said that Mr. Acimovic still wanted details on the maps.  The drainage report has many details on how to determine the size of the rip rap.  Details are printed out on Sheet #4.  Mr. Ianni spoke concerning the central wetland, which is sitting in a 4-5 acre bowl.  He gave details of the vegetation.  Signage on the conservation easement was briefly discussed.

MOTION:  To approve  #W2005-08 – Application for 15-Lot Subdivision – Lechowicz Estates
                   Section II, on property on Mihaliak Road Ext, with the following conditions:
1.  That the outstanding details from Karl Acimovic’s 6/13/05 memo, #4 and
    #5, be added to the plans as well as signage for the conservation easements
    near the vernal pools.
2.  Details of the signage should appear on the plans.

3.  File #W2005-13 – Application for a 7-Lot Subdivision on property at 150 Clint Eldredge
    Road (Map 12, Lot 20, 19.096 +/- acres).  Owner/Applicant:  CE Road, LLC.   (Contact:  
     James Bugbee).  (Received 4/25/05, Decision by 6/27/05.)

Tim Dawson gave out revised plans dated 6/10/05.  He said that Karl Acimovic had not gotten back to them as of yet.  He said that driveway drainage was an issue.  He said they have agreed to show the trench drain on the cut sides of the driveways and to partition them.  There is little increase in the flow, and the drainage system in place will accept it.  The plunge pool is undersized now.  P&Z might ask for a detention easement.  

Metzler said he would like to wait for comments from Karl Acimovic prior to making a decision.  He said that impact on the watercourses was “pretty minimal,” and recommended that the Commission approve.

4.  File #W2005-14 – Application for construction of single family home on property at 282
    Daleville Road (Map 7, Lot 5-A3).  Owner/Applicant:  Patricia & Robert Elliot.  (Received
    4/25/05; Decision by 6/27/05.)

Mark Peterson of Gardener & Peterson Associates, the applicant, and Soil Scientist John Ianni were present.  Mr. Ianni delineated the wetlands, and said there was no activity within 100 ft. of them.  A letter has been written for the file.  Mr. Peterson said there had been concern about movement of sediment.  He said a gravel driveway is proposed.  Sediment basins and water bars are present to divert and collect.  He showed maps with 10 ft. contour intervals.  He gave the rationale for the driveway location, showing photos.  He said they are following the rough driveway for the proposed driveway.  The area that’s been cleared has been topo’d.  Metzler asked if the driveway will be within the regulated area, and Mr. Peterson replied yes.  Metzler asked about the parcel, and Mr. Peterson replied that a very large parcel was left over from a previous subdivision.  He said they were not proposing the creation of any new lots.

5.  Cease and Desist Order issued to Joseph Voboril
     re:  Clover Springs Subdivision, Wetlands Permit #W2004-04 off Battye Road

Mr. Voboril asked if Karl Acimovic or Dave Askew had sent in their comments, and Jones replied no.  Mr. Voboril said some seeding that was done recently took well.  The slope is not done.  Jones said he would go out and look over the area.

MOTION:  To modify the Cease and Desist Order for the Clover Springs Subdivision to
                   allow completion of the road.

7.  File #2003-49 – Notice of Violation – TravelCenters of America (the Lessee) and George
    Giguere of Royce Properties (the Owner) of property located at 327 Ruby Road.

Dirrigl said that the truck stop is hiring or has hired REMA to monitor the steam to get more information.  More information may be forthcoming.
